El siguiente artículo se inscribe dentro de los problemas de la deliberación y constituye un análisis de la razón pública rawlsiana. Apoyados en una concepción ralwsiana de razón pública entendemos que se pueden dar respuesta a las principales objeciones que se han planteado contra este modelo, particularmente, desde el modelo habermasiano. De allí que buscamos dar cuenta de lo propicio que es el umbral de apertura que propone el modelo.

Impaired emotional capacity in antisocial populations is a well-known reality. Taking the dimensional approach to the study of emotion, emotions are perceived as a disposition to action; they emerge from arousal of the appetitive or aversive system, and result in subjective, behavioral, and physiological responses that are modulated by the dimensions of valence, arousal, and dominance. This study uses the International Affective Picture System (IAPS) to study the interaction between the type of picture presented (pleasant, neutral, or unpleasant) and group (...) (adolescents under custody in juvenile justice centers, adolescents under non-custodial measures, and secondary school students) in the emotional assessment of these dimensions. The interaction between the study variables was statistically significant. Statistically significant differences were found between the three types of pictures presented, in the ratings of unpleasant pictures between the custody group and the group of secondary students in regular schooling in valence, and in the ratings of unpleasant, neutral, and pleasant pictures in arousal, between the custody group and all groups. Discriminant analyses of each affective dimension indicate that the unpleasant pictures with violent and/or aggressive content tend to be in the functions that most differentiate the antisocial groups. Many philosophers reject the view that well-being over a lifetime is simply an aggregation of well-being at every moment of one's life, and thus they reject theories of well-being like hedonism and concurrentist desire satisfactionism. They raise concerns that such a view misses the importance of the relationships between moments in a person's life or the role narratives play in a person's well-being. In this article, we develop an atomist meta-theory of well-being, according to which the prudential value of a (...) life depends solely on the prudential value of each moment of that life. This is a general account of momentary well-being that can capture different features of well-being that standard atomistic accounts fail to capture, thus allowing for the possibility of an atomism that is compatible with a variety of well-being theories. Contrary to many criticisms leveled against momentary well-being, this well-being atomism captures all of the important features of well-being. (shrink)

In this paper we discuss James Buchanan’s contribution in the narrow domain of understanding committee voting under majority rule. We then go on to discuss Charles Plott’s seminal experimental work on the topic that sparked a wave of public choice experimental work. However, given Plott’s claims that Buchanan influenced him significantly, it is puzzling that his work with Morris Fiorina explores a question outside of those which Buchanan and Tullock found interesting. We suggest several ways to resolve this tension. The closure of schools as a result of COVID-19 has been a critical global incident from which to rethink how education works in all our countries. Among the many changes generated by this crisis, all teaching became mediated by digital technologies. This paper intends to analyze the activities carried out during this time through digital technologies and the conceptions of teaching and learning that they reflect. We designed a Likert-type online questionnaire to measure the frequency of teaching activities. It was (...) answered by 1,403 teachers from Spain. The proposed activities varied depending on the learning promoted, the learning outcomes, the type of assessment to which the activities were directed, and the presence of cooperative activities. The major result of this study was that teachers used reproductive activities more frequently than constructive ones. We also found that most activities were those favoring verbal and attitudinal learning. The cooperative activities were the least frequent. Finally, through a cluster analysis, we identified four teaching profiles depending on the frequency and type of digital technologies use: Passive, Active, Reproductive, and Interpretative. The variable that produced the most consistent differences was previous digital technologies use These results show that Information and Communication Technologies uses are reproductive rather than constructive, which impedes effective digital technologies integration into the curriculum so that students gain 21st-century competencies. Innovation is strongly associated with survival and growth of all kind of organizations in a global competitive economy. Moreover, nowadays companies are increasingly questioned on how they deliver innovative solutions to deep-seated problems, such as poverty. Our research aims to understand how Economy of Communion companies respond to this challenge by applying the logic of gratuitousness and giving. This paper examines the altruistic behaviour of EoC leaders and the connection with organizational innovation, necessary for firm’s survival in the long-term. We (...) analyse these connections through a qualitative descriptive case study of three Spanish EoC companies. The findings reveal altruistic behaviours of leaders seeking the Common Good. Innovation derives from the desire to help others, such as employees and customers. Moreover, the findings reveal that a culture of dialogue among employees, managers and the whole organisation enhances risk-taking and, therefore, innovation The paper contributes to our understanding of how EoC companies are able to reconcile innovation with the ideal of altruism, distinctive of the Economy of Communion. We believe that this study opens up a wide range of future research opportunities on the antecedents of an innovative organizational culture. (shrink)

The use of predictive systems has become wider with the development of related computational methods, and the evolution of the sciences in which these methods are applied Solon and Selbst and Pedreschi et al.. The referred methods include machine learning techniques, face and/or voice recognition, temperature mapping, and other, within the artificial intelligence domain. These techniques are being applied to solve problems in socially and politically sensitive areas such as crime prevention and justice management, crowd management, and emotion analysis, just (...) to mention a few. However, dissimilar predictions can be found nowadays as the result of the application of these methods resulting in misclassification, for example for the case of conviction risk assessment Office of Probation and Pretrial Services or decision-making process when designing public policies Lange. The goal of this paper is to identify current gaps on fairness achievement within the context of predictive systems in artificial intelligence by analyzing available academic and scientific literature up to 2020. To achieve this goal, we have gathered available materials at the Web of Science and Scopus from last 5 years and analyzed the different proposed methods and their results in relation to the bias as an emergent issue in the Artificial Intelligence field of study. Our tentative conclusions indicate that machine learning has some intrinsic limitations which are leading to automate the bias when designing predictive algorithms. Consequently, other methods should be explored; or we should redefine the way current machine learning approaches are being used when building decision making/decision support systems for crucial institutions of our political systems such as the judicial system, just to mention one. This review article provides a new perspective on the ethics of green nudging. We advance a new model for assessing the ethical permissibility of green nudges (GNs). On this model, which provides normative guidance for policymakers, a GN is ethically permissible when the intervention is (1) efficacious, (2) cost-effective, and (3) the advantages of the GN (i.e. reducing the environmental harm) are not outweighed by countervailing costs/harms (i.e. for nudgees). While traditional ethical objections to nudges (paternalism, etc.) remain potential normative (...) costs associated with GNs, any such costs must be weighed against the injunction to reduce environmental harm to third parties. Algorithmic decision-making systems have the potential to amplify existing discriminatory patterns and negatively affect perceptions of justice in society. There is a need for a revision of mechanisms to address discrimination in light of the unique challenges presented by these systems, which are not easily auditable or explainable. Research efforts to bring fairness to ADM solutions should be viewed as a matter of justice and trust among actors should be ensured through technology design. Ideas that move us to explore the (...) notions of justice within the field of political thinking, aiming to identify the elements that frame the social context of the discriminatory decisions produced by algorithmic decision-making solutions. Our explorations suggest that the efforts to bring fairness to ADMs should be seen as a matter of justice and that trust in these systems can be ensured through careful technology design. (shrink)

Este artículo analiza el tejido de prácticas económicas alternativas en la ciudad de Valladolid, una ciudad media alejada de los contextos urbanos sobre los que se ha construido el cuerpo teórico que indaga en el potencial transformador de redes de consumo, mercados de trueque, bancos de tiempo, monedas sociales o huertos comunitarios. El trabajo, consciente del (...) valor del contexto y de la escala, propone para ciudades como la estudiada una relectura que sitúa dicho potencial no en el ámbito económico, sino en el de la práctica y la experiencia social y en el de la cultura política.The last decade has witnessed an important development of practices that involve alternative proposals to the dominant production, consumption and exchange patterns. In the present article, we present an analysis of the interwoven patterns of alternative economic practices in Valladolid, a mid-sized city in Spain. This urban profile differs from the cities that have typically been used to design the body of research on the transformation power that consumer networks, bartering, time banking, social coin and community orchards have. Taking into account the value of both the context and the scale under investigation, this study proposes a reanalysis for these types of cities: under this view, the potential is not placed in the economic sphere but rather in the social practice and experience as well as in the political culture. This dissertation studies modern European philosophy's reflection the historical appearance of the human sciences, under the spell of either positivist ideology or historicism, while also making their scientific character a philosophical issue. The work thus hopes to situate the human sciences in an historical context out of which they become unintelligible: the philosophical reflection that, throughout late modernity, has registered their progressive appearance as disciplines of an uncertain and often questioned degree of scientificity. In this way, it challenges a standard (...) practice of 20th c. philosophy of science---to start with the tradition inherited from logical positivism, as though the genre began ex-nihilo around the time, or with, Popper's Logik der Forschung. ;The historical itinerary reconstructed begins with the antinomy nature/freedom in modern philosophy, particularly as it appears in the Kantian corpus. This is followed by an analysis of the dissolution of system philosophy against the background of the movements that constitute the historical matrix of the human sciences: positivism and historicism. Then the work considers the "return to Kant" in Dilthey and the neo-Kantians, which is a conscious attempt to reenact philosophical theories that may serve as scientific meta-language. Finally, the dissertation traces the reception of this Fragestellung in the phenomenologies of Husserl and Heidegger, particularly in the latter's turn from a destruction of metaphysics to a critique of science and technology. ;At the same time, the historical appearance of the sciences of man is considered together with the crisis of philosophy as epistemology or general theory of knowledge. This is done without disregard to the irreversible character of the epochal differend between science and philosophy, evidenced by the crisis of epistemology as scientific meta-language and the rise of an autonomous self-reflection of sciences that constitutes their own "philosophy of science." Thus the work's conclusion attempts to find the epistemological site of a reflection on man that may go beyond the empirical in the discursive space that opens up between natural science and the retreat of philosophy as theory of knowledge. El artículo se propone levantar su obra del olvido. Para ello analiza Su día gris desde el comentario dramatológico. Se afirma que la obra está en sintonía con una vertiente de la dramaturgia chilena (...) de comienzos de 1960, en que los dramaturgos escenifican la crisis de la vida y valores de una clase media citadina. Se proponen tres ejemplos históricos para mostrar cómo la religión, en la forma del cristianismo católico, ha promovido el avance de la filosofía moral o la filosofía social. Frente a posiciones que entienden que la religión tiene como función principal la conservación del status quo de una sociedad en particular (Marx o Durkheim) estos casos notables muestran que más bien es al contrario: las motivaciones religiosas han provocado cambios en la forma de pensar que inevitablemente implican cambios en el modo (...) de vida (Weber). Elegimos tres autores ligados por la época y el espacio (Siglo de oro español) y la religión (cristianismo católico). Juan Luis Vives propuso desde la filosofía cristiana que inspira todo su trabajo una asistencia regular y organizada a los pobres, que andando el tiempo se convertiría en la asistencia social contemporánea. Francisco de Vitoria, reflexionando sobre las causas de la guerra justa, los títulos de conquista o esclavitud, sentó las bases del derecho internacional al margen de la imposición violenta. Juan de Mariana hizo una reflexión política limitando tanto el poder del emperador que incluso sugirió la posibilidad del tiranicidio en caso de necesidad. Estos tres autores nos muestran que, aunque la religión continúa jugando un papel importante en la transmisión del estado de cosas, también ejerce una influencia que permite la evolución en las costumbres y, en consecuencia, en la reflexión ética. El humanismo contemporáneo se enfrenta al relativismo epistemológico. Si no hay una noción clara de verdad, tampoco puede haberla de la verdad del ser humano. Buscando en la tradición filosófica, nos proponemos indagar en la obra de tres referentes para el tema de la verdad: Platón, San Agustín y San Anselmo. A los tres les une un aire de familia; a la evidente relación entre San Agustín y San Anselmo se le une el hecho de que ambos bebieron de las (...) fuentes de Platón y que Platón además fue el primer filósofo pagano en impactar significativamente en la teología cristiana. El Protágoras de Platón, el Contra Académicos de San Agustín y el De veritate de San Anselmo son tres obras unidas por una misma intención temática: la búsqueda de la verdad en todos los ámbitos de la existencia frente al desafío relativista; y por una misma forma literaria: el diálogo. Así pues, tres diálogos de tres maestros hablando sobre la verdad pueden ser una magnífica ocasión para oponer un dique a las habladurías, la curiosidad y la ambigüedad en la reflexión referida al ser humano. El artículo es uno de los resultados de la tesis denominada: El derecho administrativo desde el nuevo contexto constitucional a partir del cine colombiano: Dos mujeres y una vaca y El abrazo de la serpiente, realizada como trabajo final para la Maestría en Derecho Administrativo de la Universidad Autónoma Latinoamericana. En el artículo Cine y Derecho se plantean como dos producciones culturales de honda trascendencia en las sociedades actuales y, particularmente el cine aborda nuevas miradas sobre diversos fenómenos sociales, políticos (...) y jurídicos, que le permite evidenciar matices, lecturas y puntos de vista. Por esto el artículo tiene como objetivo repensar el Derecho Administrativo utilizando el análisis fílmico como herramienta para descifrar las conexiones entre cine y ésta disciplina jurídica. Para ello se analizan dos películas en función de visibilizar sus conexiones con el Derecho Administrativo. En Dos mujeres y una vaca se evidencia que la película constituye una interpelación desde el séptimo arte a una sociedad que no se reconoce en la memoria de la guerra que ha padecido y a un Estado que no garantiza eficazmente las seguridades vitales, derechos y propiedades de los ciudadanos. En el caso El abrazo de la serpiente la película constituye un llamado para que el Estado fomente una visión más amplia y holística de la naturaleza que reconozca la integralidad y codependencia de todos los elementos naturales en el ecosistema. Ambas películas hacen un llamado al Estado que supone generar un cambio de paradigma, transformar profunda y fundamentalmente la administración pública, orientar la vocación de servicio público al bien común. Background: Heart rate variability (HRV) has been considered as a measure of heart-brain interaction and autonomic modulation, and it is modified by cognitive and attentional tasks. In cognitive tasks, HRV was reduced in participants who achieved worse results. This could indicate the possibility of HRV predicting cognitive performance, but this association is still unclear in a high cognitive load sport such as chess Objective: To analyse modifications on HRV and subjective perception of stress, difficulty and complexity in different chess problem (...) tasks. Design: HRV was assessed at baseline. During the chess problems, HRV was also monitored, and immediately after chess problems the subjective stress, difficulty and complexity were also registered. Method: A total of 16 male chess players, age: 35.19 (13.44) and ELO: 1927.69 (167.78) were analysed while six chess problem solving tasks with different level of difficulty were conducted (two low level, two medium level and two high level chess problems). Participants were classified according to their results into two groups: high performance or low performance. Results: Friedman test showed a significant effect of tasks in HRV indexes and perceived difficulty, stress and complexity in both high and low performance groups. A decrease in HRV was observed in both groups when chess problems difficulty increased. In addition, HRV was significantly higher in the high performance group than in the low performance group during chess problems. Conclusions: An increase in autonomic modulation was observed to meet the cognitive demands of the problems, being higher while the difficulty of the tasks increased. Non-linear HRV indexes seem to be more reactive to tasks difficulty, being an interesting and useful tool in chess training. (shrink)

Resumen: Mediante un ejercicio hermenéutico se sostiene que la identidad personal supera la aporía del tiempo al construirse como relato de ficción. Primero, se plantea que el relato de ficción se inscribe en el círculo de la mimesis; segundo, que la imaginación es la facultad que crea el sentido de la identidad personal como relato de ficción; tercero, que es la imaginación la que establece la relación entre relato de ficción, innovación semántica e identidad personal; y cuarto, que la identidad (...) personal se crea a sí misma por medio de la generación sentido gracias al relato de ficción. Abstract: Through a hermeneutical approach, this paper states that personal identity overcomes the aporetic of time when built as a fictional narrative. First, it proposes that the fictional narrative is inscribed in the mimesis circle. Secondly, that imagination is the faculty that creates the meaning of personal identity as fictional narrative. Thirdly, that it is the imagination that establishes the relation among fictional narrative, semantic innovation, and personal identity. Fourthly, that personal identity as fictional narrative stresses the importance of the narrative, which creates itself as a generator of meanings. (shrink)
